This section is intended to satisfy carrier and 10DLC requirements and applies when you provide your mobile number to us and consent to receive texts.

8.1 Enrollment and consent

You may enroll in our SMS program by:

Submitting your mobile number through our “Text with an Advisor” widget; or

Otherwise requesting or agreeing to receive text messages from us.

By enrolling, you confirm that you are the current subscriber or customary user of the mobile number you provide and you authorize FirsTrust to send text messages to that number using automated or non-automated technology.

Your consent to receive SMS messages is not a condition of any purchase or advisory relationship.

Opt-out information
You may opt out of receiving SMS messages at any time by:

and requesting that we remove your mobile number from our SMS list.

After you text “STOP,” we may send a final confirmation message to acknowledge your opt-out and then we will stop sending further SMS messages unless you opt in again.

8.3 Availability and delivery

Our SMS program is intended for use in the United States and may not be available on all mobile carriers. Delivery of messages is subject to transmission limitations and delays outside our control.

Neither FirsTrust nor any mobile carrier will be liable for delayed, undelivered, or misdirected messages.

8.4 Privacy and mobile data

Your use of our SMS program is also governed by our Privacy Policy, which describes how we collect, use, and safeguard personal information, including your mobile number and the content of text messages.

Consistent with 10DLC requirements:

Mobile information or text messaging opt-in data and consent will not be sold or shared with third parties or affiliates for their marketing or promotional purposes.

Governing law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-laws principles.

Any disputes arising out of or relating to these Terms or your use of the Site shall be brought exclusively in state or federal courts located in Florida, to the extent permitted by law.

Changes to these Terms
